Terms and Conditions of Service

Savvify Technologies (“Savvify”, “we”, “our”, or “us”) a partnership business duly registered under the laws of Kenya, provides an online platform that connects clients with independent contractors offering home-based services such as cleaning, cooking, handyman work, and other related services. By using Savvify’s services, clients (“you” or “your”) agree to the following Terms and Conditions:

1. Definitions

1.1 Client:

The individual who requests services through the Savvify platform.

1. Independent Contractor:

The service provider who offers home-based services through the Savvify platform, but is not an employee of Savvify Technologies Ltd.

1.3 Savvify Platform:

The digital web and mobile application that facilitates the connection between clients and independent contractors.

2. Services Provided

2.1 Service Scope:

Savvify facilitates access to home-based services provided by independent contractors. These services may include cleaning, cooking, handyman services, or other domestic tasks.

2. Independent Nature of Contractors:

All contractors offering services through Savvify are independent professionals. Savvify is not the employer of these contractors and does not manage or control their day-to-day activities. Savvify’s role is limited to connecting clients and contractors and processing payments.

2.3 Quality of Service:

While Savvify makes reasonable efforts to vet contractors and ensure quality service, we do not guarantee the quality, safety, or legality of services provided by independent contractors. Clients are encouraged to report issues or complaints, which Savvify will address as an intermediary.

3. Client Obligations and Conduct

As a client using Savvify’s services, you are expected to uphold certain standards of behavior toward contractors. This includes but is not limited to:

3.1 Respectful Treatment:

You agree to treat contractors with respect and courtesy. This includes avoiding:

  • Verbal abuse, threats, or any form of offensive language.
  • Physical abuse or intimidation.
  • Sexual harassment or solicitation of sexual favors from contractors.
  • Inappropriate requests, such as asking contractors to clean or handle your undergarments.

3. Non-Discrimination:

You agree not to discriminate against contractors on the basis of race, gender, religion, ethnicity, or any other protected characteristic.

3.3 Work Environment:

You agree to provide a safe and conducive work environment for the contractor to carry out their services. You are responsible for ensuring that there are no hazards or unsafe conditions that may pose a risk to the contractor while on your premises.

4. Contractor’s Responsibility and Liability

4.1 Liability for Loss or Damage to Property:

Savvify Technologies does not accept liability for any loss, damage, or theft of property that may occur while services are being rendered by independent contractors. Any claims or disputes regarding loss or damage must be settled directly between the client and the contractor.

4.2 Criminal Activity and Misconduct:

Should an independent contractor engage in criminal activities or misconduct; they will be solely responsible for their actions. Savvify Technologies shall assist the client by facilitating the reporting of such incidents to the relevant authorities, but Savvify is not liable for any actions or criminal behavior of contractors.

4.3 Insurance:

It is the contractor’s responsibility to have their own insurance coverage, if applicable. Savvify does not provide insurance for contractors or clients for damages, injuries, or loss of property during the provision of services.

5. Non-Solicitation of Contractors

5.1 Prohibition on Direct Engagement:

You agree not to directly engage, solicit, or attempt to employ or contract any independent contractor outside the Savvify platform for a period of 12 months after using their services via the platform. Any breach of this provision will result in penalties, including but not limited to termination of your account and legal recourse.

5.2 Non-Solicitation for Sexual Favors:

Clients are expressly prohibited from soliciting any form of sexual favors or engaging in any inappropriate behavior with contractors. Any such behavior will result in immediate termination of services and may be reported to relevant authorities for further action.

6. Payments and Fees

6.1 Service Fees:

The fees for the services will be clearly displayed before confirming the booking on the platform. The total fee includes the contractor’s service charge, and a percentage retained by Savvify as a platform facilitation fee.

6.2 Payments:

All payments are to be made through the Savvify platform. We do not allow cash payments directly to the contractor. Any breach of this payment policy may result in termination of your account.

6.3 Refund Policy:

Refunds will be issued at Savvify’s discretion in the case of disputes or unsatisfactory services. Clients must raise complaints within 24 hours of service completion for a valid refund claim.

7. Limitations of Liability

7.1 No Liability for Contractor Actions:

Savvify Technologies does not assume any responsibility or liability for the actions, omissions, or misconduct of independent contractors. You acknowledge that any legal claim or liability that arises from contractor actions is solely between you and the contractor.

7. No Liability for Property Damage or Loss:

Savvify is not responsible for any damage, theft, or loss of property during the provision of services by contractors. Clients are encouraged to settle such disputes directly with the contractor. If necessary, Savvify will act as an intermediary to facilitate resolution but will not assume any liability.

7.3 No Liability for Personal Injury:

Savvify does not assume liability for any personal injury, illness, or accidents that may occur on the premises where services are rendered. Contractors and clients are expected to take all necessary precautions to ensure their own safety.

7.4 Indemnification:

You agree to indemnify and hold harmless Savvify Technologies, its directors, officers, and employees from any claims, damages, or expenses arising out of your breach of these Terms and Conditions or any legal action between you and the contractor.

8. Dispute Resolution

8.1 Dispute Between Client and Contractor:

In the event of a dispute between a client and a contractor, Savvify will act as a neutral intermediary to facilitate a resolution. However, Savvify is not responsible for enforcing any agreements or settlements between clients and contractors.

8.2 Legal Recourse:

If a resolution cannot be reached through our platform, either party may seek legal recourse. Savvify is not responsible for any legal costs or damages awarded as a result of such proceedings.

9. Termination of Services

9.1 Termination by Savvify:

Savvify reserves the right to terminate your use of the platform at any time if you violate these Terms and Conditions. Termination may result in the forfeiture of any unused funds or remaining services.

9.2 Termination by the Client:

You may discontinue your use of the Savvify platform at any time. However, you are responsible for settling any outstanding payments for services already rendered.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising from the use of the Savvify platform shall be subject to the exclusive jurisdiction of the courts of Kenya.

11. Modifications to Terms and Conditions

Savvify Technologies reserves the right to modify or update these Terms and Conditions at any time. Changes will be communicated through the platform, and continued use of the services will signify your acceptance of the revised terms.

12. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Savvify Technologies regarding the provision of home-based services. No other agreements, representations, or warranties, either oral or written, apply.

By using the Savvify platform, you agree to comply with these Terms and Conditions and acknowledge that Savvify Technologies is not liable for any contractor actions, loss, or damage to property.
